"Client": A person who purchases a link from Checkim.com and shall include a corporate or governmental entity.
"Link Recipient": A person who receives a link via any electronic means from client.

collect IP address information only to prosecute those who use fraudulent
credit cards on our website or use our website for criminal activity.
We DO NOT tolerate ANY fraudulent and/or criminal activity. We do

Anyone
suspected of any illegal activity will be located and reported.
Imprisonment for ten
years and a $10,000 fine just for the attempt of fraudulent credit card

will have no obligation or liability to the client
or any third party for any delay or failure of its network due to
circumstances
beyond its control, including, but not limited to computer
malfunction, trunk or telephone line failure, weather related problems,
supplier performance, or Acts of God. In addition, CHECKIM.COM does not
guarantee that results provided are one hundred percent accurate; CHECKIM.COM is
coded to find the client the link recipient's ip address, the approximate
geographical location of that ip address and the internet service provider of
that ip address. CHECKIM.COM does not guarantee that the ip address is the
actual ip address of the link recipient's computer. *The link recipient may use
various means to hide his or her actual ip address via AOL proxies, anonymous proxies,
virtual private networks, ip spoofers and even using other computers other than
his or her own computer. In addition, people who are logged into
national isp networks (ex. AOL or Compuserve) cannot be traced. Successful use of link issued is also dependent on
client's ability to get link recipient to click on link issued to and sent by
client. No refunds for used or unused links. Links expire after 30 days if not
used. To the fullest extent permitted by law,
the information is provided "as is", without warranty
of any kind, express or
implied, including, but not limited to, fitness for a particular purpose,
title, implied warranties of
merchantability. CHECKIM.COM,
its affiliates, agents and employees are not liable
to any party for any
consequential, direct, indirect, or special damages for any reliance or use
upon the information obtained
from CHECKIM.COM including but
not limited to, business interruption, lost profits, loss of programs or other
data, even if
CHECKIM.COM
is expressly advised of the possibility of
such damages. In addition,
CHECKIM.COM,
its affiliates, agents and
employees are not liable to any party for any special, consequential, direct,
or indirect damages for any
correspondence between our customers and their
link recipients or any meetings resulting from use of our information. Client
shall
indemnify, defend and hold harmless CHECKIM.COM from any
and all claims, damages or liability whatever
arising out of the services or
data. All notices hereunder shall be given in writing to CHECKIM.COM by certified mail,
return receipt requested, postage prepaid, the address
of CHECKIM.COM at
3512 E. S.S. Blvd., Box 89 Ocala, FL 34470.
If any
action shall be brought on account of any breach of or to enforce any of the
terms or conditions of this agreement, CHECKIM.COM shall be
entitled to receive from client a reasonable attorney's fee. The client shall
pay reasonable
attorneys fees and all costs incurred by CHECKIM.COM.
Client agrees that venue for any proceeding shall be in
Marion County,
Florida. CHECKIM.COM
guarantees the client that it will
fulfill the service as stated on site. The client is responsible for
correctly utilizing the services of this site. If purchased link has been
clicked, expired without use or data entered incorrectly no refunds will
given. If client believes an error has occurred, the client shall
notify CHECKIM.COM and CHECKIM.COM will determine due course of action. Client agrees to be
fully responsible for payment once results have been issued on behalf of the
client irrespective of whether the client needs or wants the information
any
longer. Should client place results into dispute we will take action to
retrieve our funds, including but not limited to placing the account in
collections. Once results have been placed in dispute for fraud
or violation of any law, our
confidentiality agreement is null and void. Should a charge be made, we
will notify the link recipient of the link request (if link has been clicked by
link recipient), and inform the proper authorities. Client will execute this agreement upon payment for a
link.
TRUTH IN DOMAINS ACT OF 2003
This site offers tools that may be used inappropriately by people to use in
violation of this act. ANY SUCH USE OF THIS SITE WILL BE REPORTED TO THE
APPROPRIATE AUTHORITIES.
18 U.S.C. § 2252B. Misleading domain names
on the Internet
(a) Whoever knowingly uses a misleading domain name on the Internet with the
intent to deceive a person into viewing material constituting obscenity shall be
fined under this title or imprisoned not more than 2 years, or both.
(b) Whoever knowingly uses a misleading domain name on the Internet with the
intent to deceive a minor into viewing material that is harmful to minors on the
Internet shall be fined under this title or imprisoned not more than 4 years, or
both.
(c) For the purposes of this section, a domain name that includes a word or
words to indicate the sexual content of the site, such as `sex' or `porn', is
not misleading.
(d) For the purposes of this section, the term `material that is harmful to
minors' means any communication, consisting of nudity, sex, or excretion, that,
taken as a whole and with reference to its context--
(1) predominantly appeals to a prurient interest of minors;
(2) is patently offensive to prevailing standards in the adult community as a
whole with respect to what is suitable material for minors; and
(3) lacks serious literary, artistic, political, or scientific value for minors.
(e) For the purposes of subsection (d), the term `sex' means acts of
masturbation, sexual intercourse, or physical contact with a person's genitals,
or the condition of human male or female genitals when in a state of sexual
stimulation or arousal.'.
